Mediation And Family Law

Not so long ago, divorces and other family law disputes were almost always settled in court. Each side would make arguments and the judge would decide on the result. This method is still used in many cases, and it has its advantages and disadvantages.

However, in recent decades, increasing numbers of people have chosen to settle their legal disputes out of court. By minimizing time in court, people are able to exercise greater control over their results, keep their legal costs down and keep more of their information private.

For family law, perhaps the most popular and important alternative dispute resolution method is mediation.

How Mediation Works

Unlike a court case, where a judge or jury makes the final decision, in mediation the parties to the dispute develop their own solution. A mediator, who is an impartial third party, helps the two sides to keep the discussion focused on resolving differences, rather than inflaming them. However, the mediator doesn't make decisions for the two parties.

Mediation can be a great choice for former couples who agree they want to divorce, but must resolve some of the details. By focusing on reaching agreement, the two parties can avoid some of the bitterness that lingers after a divorce. This can be especially important for divorcing couples who have children, and who therefore must continue to interact in the future.
